Mission Statement: This blog reviews the news of the day in light of 242 years of American history. "Nationalism," a modern day pejorative, has been our country's politic throughout history, until 2008. Obama changed that narrative. Trump is seeking a return to our historical roots. Midknight Review supports this return to normality.
The incompetence we see in this Administration is both intentional and structural. No better example exists than Obama's failing immigration policies.
The significance of this fact is found in the amnesty defense of this perverse Administration before the 5th Circuit Court of Appeals, as it tries to reverse a District Court's injunction against Obama's executive ordered amnesty, an order placed on hold by the District Court in February. Understand that the Administration is telling the Appeals Court that the justification for the amnesty order, is a thing called "prosecutorial discretion." Obama is insisting that his order is in line with existing law while it places a priority on the illegal alien population. The Administration argues that it cannot supervise the larger alien population according to existing law, and is using the amnesty order to simply realign priorities within the law . . . . . . turns out, this is an argue based on an intentional effort to deceive the Court. In other words, it is a lie.
Per the Inspector General's revelations, (all federal agencies and programs have an inspector general assigned for the purpose of oversight), Homeland Security does not have the ability “to fully assess its current immigration enforcement activities and to develop future policy.” Because the Department of Homeland Security is not collecting this data and “does not have a mechanism to continuously monitor its use of prosecutorial discretion,” it lacks the ability to “improve future policy.”
Because of this institutional/structural failure (no doubt intentional on the part of the Administration), it may be "missing opportunities to strengthen its ability to remove aliens who pose a threat to national security and public safety,” according to Roth.
Understand that Obama is a no-borders, Utopian Marxist of the first order. He simply does not believe in borders, and has the European Union as his prime example.
Besides the failure to monitor his amnesty program for efficiency, he cannot monitor the program against convicted foreign felons. According to ICE, they have released into the US population, 36,000 convicted foreign felons in 2013 and 30,500 alien felons in 2014.
You should know by now, after nearly 7 years of abject failure, that Obama's perceived "incompetence," is more an issue of failed ideology wrapped in a disdain for this country's historicity and founding documents.
Simply put, he and his wife, do not like America as it is, or, how it got to its present state . . . . . but more on that in a latter post.
Exactly what is illegal about cutting deportations and unifying familes?
Questions:
If he cares so much about the Hispanic people and this immigration problem, specifically, why did he not solve the problem, as promised, during his first year? For two years, the GOP had no legislative voice, making 2009 and/or 2010 the perfect time(s) to pass this legislation.
But he chose not to do this. Why? Obama and his henchmen, want you to believe that he, personally, was working on ObamaCare and did not have time for anything else.
He and his "did not have time?" Seriously? Think about this: Congress had time to pass the Lilly Ledbetter Wage Fairness Act (which the Dems now try to pretend did nothing for wage equality). Congress had time to pass a one billion dollar "stimulus" bill that only paid back Democrat voters and unions and did nothing to prevent the recession. They had time to dream up the "Cash for Clunkers" fiasco that went 3 billion dollars over budget and accomplished nothing. They had time to pass a 400 million dollar Omnibus bill (late spring of 2009). They had time to write hundreds of pages of new regulations. They had time to write a 2,000 page financial bill (the Dodd/Frank "Too Big To Fail" bill). H Obama and his radical wife, had time to golf, party at the White House, raise money, and take 10 multi-week vacations during 2009 and 2010.
And how is "I was working on ObamaCare," an excuse, anyway? What in the world were they doing after March 23 of 2010? That was the day ObamaCare was signed into law. They had 9 months remaining as to One Party Rule and did nothing about immigration. Only the most uninformed and gullible believe "they did not have time."
We conclude, therefore, that he could have, and should have, but didn't, solve the immigration problem because that issue works better as bait to get out the Hispanic vote in 2012. the immigration promise worked in 2008; why not give it another try in 2012? This is the same type of scam Democrats have pulled on the Blacks each and every election cycle since LBJ, making promises as to wages and a better life, only to put those promises on the back burner, while the Ignorants in that population keep coming back to their plantation owners in the Socialist Democrat Party. I mean, they were bought and sold and controlled by Southern Democrats for a 100 years and, just can't move away from the "southern comfort" they have grown accustom to. Harsh? You betcha. True? More than you can possibly imagine. But sooner or later, there will be a Black majority that gets tired of the lies.
Back to question: what is the implicit evil in cutting deportations and keeping families together?
Answer: nothing. Those are [always] noble goals. But the problem is this, that is not all that Obama is doing. He is issuing Social Security numbers and work permits to those who are illegally here. That is in violation of the law. He is not simply working around Congress or playing out his discretionary privileges as to the implementation of law. He is rewriting law in giving work status and issuing Social Security identities to those who are illegally here.
I live in California. The nut jobs who run this state, are going to issue driver's licenses to these folks. If they have legal status, a Social Securitiy number and a driver's license complete with an established address, they will be allowed to vote in California although the State has not ruled that they can. How can this be? Understand that if they, the illegals, have a verifiable ID and address, there is no mechanism in this state that would keep them from voting, legally or otherwise.
When I go into the voting station to vote, I am asked to verify my address and sign a ledger, confirming that I am registered to vote. If my name is not on the list, my vote is accepted with my signature and submitted address, and I move on.
While this is not true for many states in our Union, it is true in California and any state that now issues driver's licenses.
Obama can say, "They do not have the right to vote" until the cows come home. The fact is, Obama's executive action allows these illegals de facto voting privileges, and, if states are prevented from requiring voter ID, the immigrant population, under Obama, can change the course of our national elections beginning in 2016.
That is what is wrong with all this. Benefiting the migrant population while disenfranchising the larger and native population is simply wrong. And, so, the battle must continue while the Courts still have a record of commonsense legal decisions on their side.
A note about the minimum wage: facts that are not commonly reported.
Around 11:30 pt, today, Obama signed an executive order, raising minimum wages for folks who work for contractors signing new contracts with the Federal Government.
I was an engineering contractor in California. Going back 20 years and more, I am not aware of any contract opportunity I on which I offered a bid that included included funding from the Feds, that did not require union scale wages . . . . . which means that Obama is all smoke and mirrors on this one. All he gets out of this is a photo-op and the pretense that he is actually doing something. The fact of the matter is this: the action taken today, effects almost no one.
Nation wide, only 1% of the general population earn minimum wage and most of those folks are young people, untrained and entry level employees . . . . . and no one in the Federal Government makes or earns minimum wage . . . . . . no one.
Midknight Reviews 12 point platform for reform in the new 112th Congress
Editor's notes: understand that Obama is not a dictator, but he often functions as if he were. The problem? Certainly it is Obama but more than that, it is the system of presidential powers that has been allowed to increase over the years. Among the first order(s) of business with the 112th Congress (taking office on January 20th) is a review and a revision of presidential authority. If the reader has suggestions or criticisms, please address your thoughts to midknightmail1@aol.com
1. Czars: If the appointment of "czars" is allowed to continue, the number and job description must be authorized by [at least] the Senate. As it stands, now, Obama has nearly 50 czars, folks appointed by him and without Congressional approval. As "czars," they are considered to be presidential staff and are not subject to subpoena or Congressional review at any level.
2. Executive Order: the fact that it is entirely possible, apparently and according to recent news reporting, for Obama to give amnesty to 12 million illegal aliens is evidence of a president who is out of control. We need to limit executive order and use the threat of impeachment when those rules are violated. Because of Obama, we now know that a true "dictatorship" is possible via a creative president using the powers that are allowed to him, the executive privilege given to his position, te complicity of a Marxist oriented free press and the regulatory powers of Federal agencies such as the EPA, the FCC, the FTC, and NEA (look for definitions at end of article), to name a few, under his control.
3. Presidential time in office: the two term limit for a sitting president is the result of the 22nd amendment to the Constitution -- making it much more difficult for a dictator minded individual to become just that, a long term dictator. Congress needs to review this amendment with a view of ensuring its continuation. There must never be a short-circuited legislative reversal to this amendment.
The socialist, FDR, was elected to four presidential terms - the only president in American history to serve more than two terms. With all the talk of how the American people loved this guy, it is curious that immediately after his time in office, the 22nd amendment was proposed, passed and ratified by the several states - a process that took 4 years (1947 to February of 1951) .
4. Proof of Citizenship: since the free press has abdicated it's self-appoint responsibility to fully vett presidential candidates, the qualifying issues of age and citizenship should become a matter of a mandated evidential procedure of some sort. When folks asking for proof of age or citizenship are regarded as "wacko's," it is time for Congressional mandates on the issue.
5. "Treason" needs to be defined and enforced or officially disregarded.
6. GITMO needs to be continued and modified to meet current practical and populace demands. The detention center cannot be closed. From time to time, we will capture foreign enemies, hell bent on killing Americans, who cannot be tried in a civilian court of law for reasons of national security. Understand that the Supreme Court allows for such a circumstance. We need to aggressively pursue a revitalization of the use of GITMO or a similar institution.
7. Powers of a Lame Duck Congress: under no circumstance should a lame duck congress be allowed to legislate new laws introduced after mid-term and presidential elections. If particular issues have not be formally introduced into the legislative debate well before a congressional/presidential election, they should not be allowed to be presented in the time following those elections and the last day of that congresses activities (January 19th following the specific election. The work of a lame duck Congress should be limited to the completion of legislation already introduced. If nothing else, all legislation introduced and/or passed by a lame duck congress must be reviewed by the new congress.
Tom Harken , a Marxist leaning Senator from Iowa, wants to use the lame duck Congress to pass the "card check" that would allow unions to take over factories, shops and companies without a secret ballot vote. This should not be allowed as a matter of law.
Understand that a new congress comes into power every two years -- after the so-called 'midterms' and, again, after the presidential election.
8. 5 Day review: all written legislation must be posted to the Internet for at least 5 working days (not including the weekends). If our politicians refuse to read the laws they pass, certainly the people those laws will govern should.
9. Reconciliation: the rules for reconciliation need to be redrafted to insure its limited use - for budgetary matters only and to the original bill in question.
10. Filibuster Rule: without this procedure, the minority party has little to no power in the Senate. The Dems bitch about this procedure now, but loved the things when they were the minority party - as they will be again. The rule needs legislative streghtening -- perhaps a requirement of additional Senatorial votes (66 or 2/3 majority) to amend the rule. The balance of power is a concept that has nearly been lost over the years --- on all levels of government.
11. Deemed to have past: this is a rule in the House that allows a spending bill to be declared as "deemed to have past" without the House actually voting on the bill. This needs to be taken down. It is an issue, today, because of the Dems refusal to actually pass a fiscal budget for 2010/2011. Instead, they have opted for passing a spending bill offered AS A BUDGET under the rule of "deemed to have past." No vote is taken. Most importantly, it is only a "budget" in the House. The Senate has no such provision.
12. Repeal of the Wealth Tax: a tax of 1.8 % (soon to be 25% or more) of the estimated worth of all the assests of those deemed as "wealthy." Understand that the highest tax bracket will rise from 35 % to 39% federal, 10% on average in many states, and now, a summary tax on on thier accumulated worth. Remember the good old days we talked against "double taxation ?" When exactly did that bit of rhetoric go down the drain?
End notes: EPA - Environmental Protection Agency; FCC = Federal Communications Commission; FTC = Federal Trade Commission; NEA = National Education Agency.
