But, before that appoint is confirmed, if ever, the newly divided 8 member court would align itself 5 to 3 in favor of a more conservative reality.

It would be in the favor of the GOP to not confirm anyone. As I just stated, the next 8 member court will probably be a 5-3 conservative court. No rush on confirmations needed.
