Kagan will NOT recuse herself

In the world of pointie heads and academics, Elena Kagan is the cream of the crop. But she is no judicial legalist. Rather, her far left preferences for social reform and the role the courts can and should play in that revolutionary process is the disturbing fact in her appointment to the Supreme Court.

The big news of the day has to do with her refusal to recuse herself from the coming deliberations over ObamaCare. I, personally, do not care. One way or another, the Courts opinion will be the end result of a 5-4 split decision. No one knows for sure, in which direction that will go.

I do remember comments being made at the time of her appointment to the High Court, that she would recuse herself if the health care bill made its way to the Court. But most have forgotten those comments. The full compliment of the Court's legislative body, all nine members, will be in on this deliberation, barring a health crisis of some sort.

One thing for certain, if the GOP wins the coming election is regal style, Constitutional/legislative processes allow for ObamaCare's repeal. Never forget that it was this very issue, ObamaCare and its fraudulent legislative creation, that gave rise to the T.E.A movement and continues to fuel the fires of the conservative effort to take back this country.

If the High Court decides against this piece of legislative idiocy, it is only because conservatives brought the bill to the Court "just in the nick of time." A year or two or three for now, the Court might be so liberal in its make up that such bills would sale through its legislative oversight.

In the end, we all will just have to wait for the Court's decision and plan our subsequent strategies after that fact.

Update: we should all know that Kagan participated in early talks dealing with developing strategies designed to combat legal challenges to the health care law. I did not know this and it changes everything for me. Should she recuse herself? Duh.
