Applications for waivers from annual limit requirements are reviewed on a case by case basis by Department officials who look at a series of factors including whether or not a premium increase is large or if a significant number of enrollees would lose access to their current plan because the coverage would not be offered in the absence of a waiver. Approved applicants are granted an annual limit waiver for one year. Understand that the size of the corporation or agency seeking exemption is not the determining factor. More than 40 entities employ less than 40 personnel. One has a single employee, another has two. No one knows what standard is being used to determine these exemptions. It is clear that ObamaCare is an increasing joke and the chart evidences that claim.
