Lawyers appearing on FoxNews, this morning, want the public to know of recent court decisions that stand in opposition to the MERS claim presented in these words from the MERS website:
Mortgage Electronic Registration Systems, Inc. (“MERS”) is a proper party that can lawfully foreclose as the mortgagee and note-holder of a mortgage loan. MERS Membership Rule 8 provides required guidelines that must be followed when MERS is the foreclosing entity. . . ."
Recently, a number of court decisions against certain foreclosure procedures have been recorded. One of these decisions is reviewed in an article, here.
Attorney Robert Massi, an injury attorney in Nevada, who also deals with property issues, bankruptcy and foreclosure suits, made the morning's news with his comments about the court's opinion with regard to MERS notifications. You might check with your local bank on this matter, or call Massi's offices for advice on who you can talk to. His number, in Nevada, is 702.870.1100.
