Copyright law as stated from the Feds:

This right [protection by service of copyright law] is subject to certain limitations found in sections 107 through 118 of the copyright law (title 17, U. S. Code). One of the more important limitations is the doctrine of “fair use.” The doctrine of fair use has developed through a substantial number of court decisions over the years and has been codified in section 107 of the copyright law.

Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered fair, such as criticism, comment, news reporting, teaching, scholarship, and research. Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

    1. The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes
    2. The nature of the copyrighted work
    3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole
    4. The effect of the use upon the potential market for, or value of, the copyrighted work

Secondly, sites such as ours function for the obvious purpose of educating the reading audience of the facts and their consequences in the political domain.

Recently, 73,000 "download" sites were shut down by the Feds for copyright violations. Understand that these sites were a part of a block of sites on a server run by Word Press. They were not individually singled out.

If your individual site is in violation of copyright infringement and reported, you will receive a "cease and desist" order from the DMCA before further action (as in "shut down") is taken. It is understood that "fair use" laws allowing one to quote the work of another without permission are ambiguous in scope. How do we know ? The Feds admit to this problematic issue. Because of this ambiguity, notice is given and opportunity for compliance offered before action is taken.

It is not clear if notification is sent to a blog's registered email box or sent to the registered owner's address via snail mail . . . . but notice will be given.

If you comply in a timely fashion to the DMCA order, you will be fine.If you have not received a DMCA notice, you are not considered to be in violation of anything. Check your mail.

Example: let's say that you use a particular photo or piece of artwork in your blog's header. DMCA does not busy itself with checking out sites and looking for such "violations." If there was a complaint filed against you, by some sophomoric do-gooder or an angry liberal tattler, you would first receive notice and given opportunity to comply.

DMCA receives "informant" information by the hundreds, each day. For the most part, they dismiss these childish reports out of hand.

Acceptable downloads as per government documents include these considerations:

Verbatim quotes from public officials, quotes made in the public domain, any article in the public domain written or produced by government personnel or agencies, facts of any nature, information for the purpose of research or critical commentary.
