Kagan is -- like Obama -- an anti-Constitutionalist. Here is proof.

Kagan denies the 9th amendmentt in her refusal to recognize "unalienable rights" as stated in the Declaration of Independence and does not see the Declaration as context for Constitutional Law.

She opposes the traditional view of the 1st amendment and free, unqualified political speech.

She has no reason to use the 10th amendment in any of her decisions whatsoever.

The 2nd amendment as relates to individual gun ownership is not her interpretation, preferring the notion that the 2nd amendment is talking about the freedom of a militia's right to own guns.........and, of course, which Progressive believes in militias ?

Elena Kagan wants the confirmation committee to believe that she does not know what a Progressive is.

She separates the Declaration of Independence from Constitutional law and will not appeal to that Declaration in any of her dealings.

She believes that the role of the courts is to "protect the people" and in that announcement, declares herself to be more than a jurist when it comes to interpreting the law as written. Because she is a social activist, she finds little use for the 5th amendment, preferring, of course, to alter the meaning of the Constitution via judicial decision --- assuming, of course, that such decisions are progressive in content and purpose.
