In the news today: Keystone flops on the Senate floor; Landrieu looks finished; Obamacare rollout chief bullied employees; Obama preps activists for immigration order; illegals already being released; GOP may be able to fight him without a shutdown; and Muslim groups are trying to get in on the Ferguson action.

Keystone bill fails by one vote . . . A Senate bill aimed at approving the Keystone XL pipeline stalled Tuesday, dealing a blow to Sen. Mary L. Landrieu’s tough re-election bid. Republican leaders plan to bring the pipeline legislation back up next year, when GOP reinforcements appear certain to bring it over the line and to President Barack Obama’s desk. The 59-41 vote fell just one vote short of overcoming a filibuster led by Democrats.
Nothing fails in Congress by one vote. Democratic leaders decided it wasn't worth it to twist enough arms to try to save Landrieu.
Republicans pounce on Landrieu . . . Republicans were quick to argue her primary argument for returning to the Senate has now been demolished and that the outcome could further boost Rep. Bill Cassidy (R-La.). The Hill

Obamacare official's brutal leadership . . . A key ObamaCare official engaged in a “cruel and uncaring march” to launch the federal health care website last year and wasn’t open to seeking a delay despite concerns, according to a newly revealed email from her former second-in-command. In the September 2013 email to Todd Park, the former Chief Technology Officer of the U.S., Michelle Snyder characterized her then-boss, CMS Administrator Marilyn Tavenner, as a temper tantrum-throwing, demanding official who vowed the website would launch on time "no matter what." Fox News
Obama flip flop explained: He ordered a study . . . According to White House Press Secretary Josh Earnest, Obama “ordered a broader, in depth review of existing law,” broader than whatever review he’d done to come to his previous, now inoperative, conclusion that he couldn't just refuse to enforce immigration law. White House Dossier
Turley: Obama presidency becoming "very, very dangerous"  . . . Legal scholar Jonathan Turley, whose independent views lead him to be championed by conservatives and liberals alike, says President Obama’s upcoming executive action on immigration presents and “unprecedented threat” to the Constitutional order. White House Dossier
Obama action like Reagan's and Bush's? Not . . . What Obama is expected to do would go far beyond his predecessors' actions. Fox News
Reid to Obama: Go big! . . . "I believe that whatever the president decides to do on his executive order, he should go big — as big as he can — and there’s precedent for him going back to [President Dwight D.] Eisenhower,” Reid said during a press conference. The Hill
White House prepares activists . . . The White House held calls with activist groups on Tuesday to prepare them for President Obama's executive action on immigration, sources tell The Hill
Obama sleepily condemns Jerusalem attacks . . . Obama not only failed to muster any emotion, he veered straight into moral equivalency territory, noting Palestinian deaths as well and calling on both Israelis and Palestinians to “try to work together.” And he condemned “extremism” generally, presumably meaning the term to be inclusive of Israel’s settlers. White House Dossier
White House huddles ahead of Ferguson . . . Obama has been meeting regularly with top officials within his administration — including Attorney General Eric Holder and senior adviser Valerie Jarrett — ahead of the expected announcement. He received a detailed briefing from the Justice Department on Nov. 7. The Hill

Senate fails to advance NSA bill . . . The Senate on Tuesday night voted down a proposal to consider a bipartisan bill aimed at reining in the authority of the National Security Agency to collect bulk phone data from millions of Americans, an activity that was revealed after leaker Edward Snowden revealed the program last year. The Blaze

GOP may fight Obama without shutdown . . . A senior U.S. House Republican on Tuesday floated a plan to avoid a government shutdown fight in December while also setting a path for undoing sweeping immigration changes President Barack Obama is expected to execute.Reuters
Chaffetz takes over from Issa . . . The House Republican steering committee announced Tuesday that Rep. Jason Chaffetz, R-Utah, will become the new chairman of the House Oversight and Government Reform Committee. Chaffetz takes over for Rep. Darrell Issa, R-Calif., who was term-limited. Fox News

Ryan to lead tax panel . . . Rep. Paul Ryan (R-Wis.), the House GOP’s lead budget guru, was selected as the next chairman of the powerful Ways and Means Committee on Tuesday. The Hill
The panel also deals with health care, trade and other issues. One of the most powerful posts in the House.
Boehner taps Turley to wage Obama suit . . . House Speaker John Boehner has hired prominent constitutional scholar Jonathan Turley to represent the House of Representatives in its lawsuit against President Obama's unilateral move to delay implementation of an Obamacare provision requiring large firms to offer healthcare to their employees.Washington Examiner
Fear and loathing on the 2016 trail . . . A slew of significant staff changes among top contenders show that the presidential gears are already turning—and fast. On Tuesday, Sen. Rand Paul's political team announced that it had poached digital strategist Vincent Harris from Ted Cruz. "I am just excited to join an operation that's behind a candidate and a man who is not only a thought leader but also somebody who can naturally speak to the tech community across the country," Harris said in an interview. National Journal
Dems reelected Pelosi to lead them . . . House Democrats on Tuesday reelected Rep. Nancy Pelosi to serve as minority leader for another two years. The 74-year-old California Democrat - in power for the last dozen years - will once again try to regain the House majority in 2016. Politico

Fifth person dead in Jerusalem attack . . . An Israeli police officer has died of his wounds from an attack at a Jerusalem synagogue by two knife-wielding Palestinian men earlier today, bringing the death toll in the assault to five. The attackers also killed four rabbis, three of them American. ABC News
Attack shakes Israelis deeply . . . The scale and the targeting of worshipers in a synagogue rattled Israelis more deeply than any other attacks recently in the city. “I felt like I was in a butcher shop,” said Albert Albukai, a medic who heard the gunshots while praying at a neighboring synagogue. Wall Street Journal

Muslim groups seek to co-opt Ferguson protests . . . Muslim groups have stepped up efforts to co-opt protests over the fatal shooting of Michael Brown in Ferguson, Mo., with a drive to equate the teen’s death to the death of a radical Islamist shot during an FBI raid in 2009, a Washington-based security watchdog group is warning. Fox News
Gun dealers report brisk sales . . . Gun dealers in parts of the St. Louis suburbs have reported brisk sales, especially among first-time buyers, as local residents wait for a grand jury decision on whether to indict the Ferguson police officer who fatally shot teenager Michael Brown this past August. Fox News

Illegals being released en masse . . . Almost all of the illegal immigrant families traveling from Central America to the U.S. are being released from the special facility meant to hold them in New Mexico, according to the mayor of the town where the special facility is located. Washington Times

Sharpton's debt issues rise to the surface . . . The Rev. Al Sharpton has made a remarkable rise to national prominence, from community organizer to President Obama’s advisor, amid a long and lesser-known history of debt and tax obligations totaling millions of dollars. Sharpton and his for-profit businesses owe more than $4.5 million in state and federal tax liens. Fox News
