Its called "the nuclear option." Senate floor discussion (sometimes called "filibuster") can only be stopped by a 60 vote majority in the Senate. When Senate bills are reviewed pertaining to finances, however, the vote to approve that legislation only requires 51 votes, eliminating floor discussion and the need for a 60 vote majority. Again, the "nuclear option" has always been reserved for financial bills. Harry Reid changed those rules to include non-financial legislation including the approval of federal judges, the presidential Cabinet, and ObamaCare. The same "rules" created by the Dems to approve Federal Court judges, presidential cabinet members and the passage of ObamaCare, are, now, going to be used to the advantage of the GOP provided the Senate passes a budget resolution that allows the nuclear option to continue.
Senate Budget Committee Chair Michael Enzi (R-WY) introduced a budget resolution Tuesday that includes "reconciliation instructions" that enable Congress to repeal Obamacare
with a simple Senate majority. Passing a budget resolution that
includes those instructions will mean that the legislation can pass
through the budget reconciliation process, in which bills cannot be filibustered.
That means Republicans will only need 50 of their 52
members in the Senate, and a bare majority in the House, to pass
legislation repealing the Affordable Care Act. According to the Wall Street Journal, the budget resolution could be passed by both houses as early as next week.
To be clear, passing the budget resolutions does not itself repeal
Obamacare. But it’s the necessary first step if Republicans are to do
that this year,
If the budget resolution fails, in a vote next week, the Dems will be able to slow the approval of Cabinet appointees, prevent GOP vote on federal court justices as well as allow ObamaCare to be dismantled.
Understand that the callous disregard for accepted procedure, back in 2010 (ObamaCare) and the 2013 rule change that allowed the Dems to appoint justices without full consent of the Senate, in all probability, will become the accepted process for the GOP. If Trump wins re-election, the GOP would have this power for 8 full years while the Dems only had the same power for four years.
The Dems did not just lose the election, they lost the federal court system, as well . . . . . . at least in terms of potential.
