Midknight Review's case against Elena Kagan. Why make the argument? Because it is so easy to do !!

Updated 11:30 pm (pst) . Apparently Ezra Klein over at the NY Times. His headline is this: Bararck picks himself for the Supreme Court. Turns out she is a Chicago croney, a tenured professor at the University of Chicago.

We begin by first reminding the readership that Obama is our first subversive president.
He has yet to define his intentions with regard to the promise to "fundamentally transform the United States." None of us have a clue as to what he has in mind. After a 17 months, we do know that it includes the confiscation of part of the auto industry in blatant disregard for the primary stockholders of GM and Chrysler, including police and teacher retirement funds; the installation of more than 45 department heads (some call them "czars") as he circumvents Congressional approval and oversight; his pursuit of a broad based attack on free speech in the workplace, against corporate political speech, against broadcast conservative talk and an continuing effort to control opposition on the internet. And, to this day, after nearly two years, no one (Marxist-lib or neo-con) has the slightest understand as to the meaning of this statement:

On July 2, 2008, Obama had this to say: "We cannot continue to rely only on our military in order to achieve the national security objectives that we've set. We've got to have a civilian national security force that's just as powerful, just as strong, just as well-funded." (go ahead, you little "moderate" nutcase -- give it a try. Exactly what are the "objectives that we've set" ?? )

Stealth is something that Obama cherishes. It gives him the upper hand. In the selection of Elena Kagan, the [stealth] beat goes on. She has no legal-paper trail because she has never used her law degree to actually practice law as a judge -- not in traffic court, trial court, divorce court, appellate court, district federal court. As Dean of the Harvard Law School, she opposed military presence on the Harvard campus because of "don't ask, don't tell) to the extent that her separate and individual filing made its way to the Supreme Court where it was found to be so out of line with accepted constitutional markers as to be rejected by the entire Court (8-0) including the radical Bada Eda Phate Ginsberg. Midknight Review would argue that her written opinion supporting this course of action is the very definition of legal incompetence. An 8-0 defeat should be an embarrassment rather than a qualification. While others have been appointed to the high Court without having served as justice, no one in modern times has come up for appointment so unqualified.

Her supporters offer these considerations:

** She is an associate at the well thought of law firm, Williams and Connolly. They forget to mention that she has been there only two years and has spent much of that time as a grunt.

** She served as Dean of Harvard's Law School where she did not distinguish herself above the frey except to push through free coffee for the students and tampons in the ladies bathrooms. Although a legal academic, she has actually written few [academic] papers and comes to the Senate confirmation proceedings in a cloud of relative anonymity -- even as an academic. Midknight Review fails to see why "Dean" qualifies Kagan for any justice position, much less the most important legal position in the nation.

** She is the current Solicitor General and in that position represents the United States in the federal court system. Total time served in this position? One year.

What do we know about this woman ? She is Obama's choice over and above hundreds of more qualified possibilities. So why did he select her? Precisely because she a) reflects his own radical Marxist views for this country and b) she has done little for which to be criticized, which, in this case, is to say that she has done little to be qualified. One would think that would be enough to keep her off the High Bench. In the Obama Administration, however, it is a high water mark. Less than 8% of this Administration has private sector non-academic workplace experience -- less than 8% including Hussein Obama. Midknight Review laughs at those who pretend Obama and Company is more politically adept than Governor Sarah Palin.
